Putting Your Legal Affairs in Order

Have you made a will and if so, is it up to date?

It is estimated that as many as two thirds of the adult population in the UK do not have a will. Many people put off making a will because they don't like the thought of making one, or perhaps they are unsure what to put in their will.

We understand why a person may be reluctant to make a will. We offer a sympathetic approach to making wills and we give our clients every opportunity to discuss their wishes in a supportive, confidential environment.

There are many misconceptions about what happens if a person dies without making a will. We aim to dispel the myths and help our clients to make wills which state their wishes clearly. We encourage our clients to review their wills regularly to make sure they are up to date.

What are the reasons for making Lasting Powers of Attorney?

A Lasting Power of Attorney allows you to appoint other people, such as members of your family, to make decisions for you if you become unable to do so, for example through physical or mental incapacity.

If you do not have powers of attorney and you lose the ability to manage your affairs, the Court of Protection will appoint someone to make decisions for you. Making an application to the court can be an expensive and stressful business for your family, but it can be avoided by making Lasting Powers of Attorney.

Where are the deeds of your house stored and do they need to be checked?

It may be that you are paying unnecessarily for your deeds to be stored. Or perhaps your deeds need to be updated, for example, if a joint owner has died and his or her name needs to be taken off the deeds. You may wish to think about having your deeds registered at the Land Registry, to avoid any problems should the deeds be lost.
