Bankruptcy relates to individuals rather than companies.
A Bankruptcy Order is made against an individual
in circumstances where an individual is unable to
pay his debts as and when they fall due.
Winding Up relates to companies. A Winding Up Order
is made against a company in similar circumstances,
where a company is unable to pay its debts as and
when they fall due.
These type of proceedings require a good knowledge
of the governing legislation of the Insolvency Act
and Rules 1986. We act for both individual debtors
and debtor companies in pursuing and defending Insolvency
Proceedings from the presentation of a Statutory
Demand through to dealing with the Partition and
attending and representing clients at the Final
Hearing as well as Insolvency related matters.
We are able to advise clients in relation to:
- Claims by Trustees in Bankruptcy for recovery
of property
- Applications for Annulment of Bankruptcy Orders
- Many other insolvency related issues
